Interpretation

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to CARTERA INTERCHANGE CORP with business address at 37th Floor of High Street South Corporate Plaza Tower 2, 26thStreet corner 11th Ave., Bonifacio Global City, Taguig City.
  • Country refers to the Philippines where the owner of the Application is located.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
    You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

When You download the Application and create an account (“Account”), we may collect certain Personal and Sensitive Personal Information (“Registration Information”) about You, such as:

The above Personally Identifiable Information or PII are required to create an account to access and use the Application which is in accordance with the MINIMUM CUSTOMER DUE DILIGENCE (CDD) requirement under the Anti-Money Laundering Act of the Philippines (Republic Act No. 9160).

In-App and Push Notifications

We may request to send You push notifications regarding Your account or transactions You executed using the Application. If You wish to opt-out from receiving these types of communications, you may e-mail us at partnerships@cartera.com.ph.

Use of Your Personal Data

Having accurate information about You permits us to provide You with a smooth, efficient, and customized experience. Specifically, we may use information collected about You via the Application to:

  • Provide You with the features and functions for which You sign up for including to enable user-to-user communications, increase the efficiency and operation of the Application through requesting feedback about Your use or resolve disputes and troubleshoot problems.
  • Process payments, refunds, loyalty and rewards redemption and prevent fraudulent transactions, monitor against theft, and protect against criminal activity.
  • Conducting analysis for purposes of research and marketing initiatives, including the creation of personal profile based on interests, preferences, mobility patterns from physical locations visited, and other information that may be relevant for marketing and market research purposes;
  • Managing Your account, providing customer care activities, monitoring the quality and security of the network, training the staff, and providing services in a timely and efficient manner, and ensuring Your fair and lawful use of the products and services provided by us;
  • Generating statistical insights based on your usage and other information to assist the Government in planning for healthcare, disaster, and other similar initiatives;
  • Credit scoring programs and initiatives, including but not limited to providing information to the Credit Information Corporation in furtherance of the objectives of Republic Act No. 9501, otherwise known as the Credit Information System Act;
  • Sending commercial and promotional advertisements and campaigns, loyalty and rewards offers, surveys, customer care, and after sales communications, and other broadcast push messages;
  • Sharing Your personal data with our business partners, authorized third-party content providers, service provider for the Service and other authorized third-party services; and such other processing or disclosure that may be required under law or regulations.
  • Liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with our Service Provider to process, collect, store, monitor and analyze Your data and use of our Service, to contact You.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

We require all third parties engaged by us to respect the security of Your personal data and to treat it in accordance with the law. Such third parties are only allowed to process Your personal data in accordance with our instructions, and not for their own purposes.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Our retention policy is seven (7) years in which we will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain Your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or change some of Your information at any time by signing into Your Account, if You have one, and visiting the account settings section that allows You to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us by e-mailing us at partnerships@cartera.com.ph and providing us proof of identification to effect the change, update or modification of Your information.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
